Obama To Ignore Judge’s Ruling To Appear In Court Over Eligibility Hearing
This past week saw Georgia Deputy Chief Judge Michael Malihi rule that President Barack Obama is to appear in court this Thursday regarding a hearing that refutes Obama’s eligibility to run for president. It appears the Judge’s order will be completely ignored by the administration.
What, if any repercussions will face the president are unknown. Presently, it appears his administration has little fear of reprisal as the mainstream media continues to ignore the case. The White House has indicated the president will be campaigning in Las Vegas and Denver next Thursday. It will be interesting to see what Judge Malihi does following Barack Obama’s violation of a legally issued subpoena.

This lawsuit has a lot of merit because it deals with the constitutional eligibility. Nothing to do with where Obama says he was born but whether or not he is a natural born citizen according to the Constitution and a Precedent setting Supreme Court Ruling of what a natural born citizen is. Obama doesn’t meet the qualifications. He is done. The States can keep him off the ballots.
Obama, through his lawyer, having opposed the subpoena with a motion to quash and the court having denied that motion to quash, the court is, in effect, ordering Obama to appear. If Obama does not appear and defend himself in the case against him by complying with the subpoena, my guess is that the plaintiff wins the case by default and Obama’s name is withheld from the Georgia ballot due to his not providing sufficient proof of his eligibility for office.
My hope is that the plaintiff, Dr. Taitz, can obtain the original SSN-5 application for the SSN that Obama is using. That will lead to another criminal lawsuit being filed in another court on charges of identify theft. That would be icing on the cake.
OPINION: HOW THIS MAY PLAY OUT.
The court will only be ordering Obama to appear once Taitz files, and the court grants, a motion to compel.
To establish ballot eligibility, Obama’s lawyer only needs to demonstrate three things: 1) natural born citizen, 2) 35 years old, and 3) 14 years’ residence. I’m sure Orly herself will stipulate the third. Obama’s lawyer need only submit a certified copy of Obama’s birth certificate to prima facie establish the first two, at which point burden of proof will shift back to Orly.
Note that none of this requires Obama to be present. Obama, through his lawyer, will refuse to comply with the subpoena even if it is not quashed, forcing Taitz to file a motion to compel. That motion will be denied because Orly is unable to articulate a clear legal argument for why Obama needs to be present for any of the above.
Once Jablonski drops the birth certificate on the judge’s desk, it’s all over for Taitz.
