Court Rules Obama DHS Violated FOIA with Stealth Amnesty Secrecy
Meaning: As was said by a former Secret Service Agent..Obama and Napolitano released thousands of illegal aliens who should have been deported..

Judicial Watch recently earned a major victory against the Obama Department of Homeland Security (DHS) in its efforts to uncover records detailing the Obama administration’s “stealth amnesty” initiative. And with DHS releasing thousands of illegal alien criminals onto the streets, it could not have come at a better time.

The United States District Court for the District of Columbia recently ruled that the Obama DHS had failed to comply with the Freedom of Information Act (FOIA) in a Judicial Watch lawsuit seeking records related to the agency’s policy of suspending some illegal alien deportations. The opinion was issued by The Honorable Colleen Kollar-Kotelly.

Our FOIA lawsuit concerns a DHS policy, implemented by Immigration and Customs Enforcement (ICE), which led to the reduction of the deportation docket in Houston, Texas, by dismissing pending enforcement proceedings against illegal immigrants who DHS claimed did not have serious criminal records. (Now we know this was a lie. Judicial Watch uncovered records showing that multiple deportation cases were dismissed against illegal immigrants who had committed serious felonies. But more on that in a moment.)

In the old days–and by the “old days” I mean 2010–this was called “stealth amnesty.” But there’s nothing “stealth” about the Obama administration’s amnesty campaign now. According to the Associated Press, since mid-February, the Obama administration has openly and proudly released more than 2,000 illegal immigrants facing deportation from jail. Reports indicate that it plans to release 3,000 more this month.

Regarding our lawsuit and the court victory, we filed our original FOIA request with DHS on August 30, 2010, and a subsequent lawsuit on March 23, 2011, after the DHS refused to release the requested records. On January 27, 2012, the U.S. District Court denied a DHS motion to dismiss in part, chastising the agency for its inadequate explanations and giving it one “final” opportunity to establish the applicability of certain privileges in withholding the information from Judicial Watch.

In the February 28, 2013, decision, the District Court ruled that with respect to a substantial number of documents at issue, DHS had continued to withhold information improperly under the “attorney-client” and attorney “work-product” privileges:

Regarding DHS attempts to withhold information under an attorney-client privilege, the court ruled in favor of Judicial Watch, declaring, “[E]ach of these documents appears to concern nothing more than the implementation of an agency policy, the withholding of which runs counter to the [DC] Circuit’s [earlier] admonition that a government attorney’s ‘advice on political, strategic, or policy issues [is] not … shielded from disclosure by the attorney-client privilege.’” (The court drew a similar conclusion regarding the DHS effort to withhold information in order to protect attorney “work-product.”)

The records at issue concern internal DHS controversy over how the Houston ICE officials were interpreting the Obama administration’s narrowed immigration enforcement priorities.

Documents previously uncovered by JW show that DHS officials misled Congress and the public about the scope of its immigration enforcement policy change, which gave wide latitude to local immigration officials to dismiss illegal alien deportation cases–including the dismissal of charges against illegal alien criminals convicted of violent crimes. So don’t believe the Obama administration’s lie that public safety is not at issue here. I believe people will die as a result of this new policy. (I cited my reasons for pessimism in last week’s update.)

But this ruling is good news at a time when the country really needs it.

It proves the Obama administration is willing to go to any extent–including gaming the courts–to continue stonewalling the full story of its lawless release of illegal aliens. Now, with the prison floodgates being thrown open to illegal aliens under the phony pretense of abiding by sequester cuts, it is more important that details of this threat to the public safety be revealed.

We’re pleased the court would not allow DHS to continue its contempt for FOIA law. We look forward to getting those records.


How Obama Turned America into Venezuela; tout de suite..

Hugo Chavez’s death was met with tributes from Iran, Bolivia, China and El Salvador. The Western left did not waste much time adding their withered roses to El Comandante’s coffin. George Galloway called him another Spartacus. Jimmy Carter described him as a leader who fought for the “neglected and trampled.” Michael Moore praised him for declaring that the oil belongs to the people.

Whether or not the oil belongs to the people is a matter of some debate considering how much of it ended up in Chavez’s pocket.

Chavez died with an estimated net worth of 2 billion dollars making him the 4th richest man in Venezuela and the 49th richest man in Latin America.

While the Bolivarian Spartacus lined his pockets with oil money, Venezuela’s middle-class was struggling to get by in a country where the private sector had imploded. Income increased on paper, but decreased in reality. Around the same time that Comrade Hugo was launching the third phase of his Bolivarian Revolution, inflation had decreased household income 8.8 percent while consumer goods prices increased 27 percent.On his deathbed, Hugo Chavez devalued his country’s currency for the fifth time by 32 percent, after tripling the deficit during his previous term when the national debt had increased by 90 percent. From 2008 to 2011, Chavez’s oil-rich government increased the debt by nearly 50 billion in a country of less than 30 million. That same year, The Economist speculated that Venezuela might go bankrupt.

Chavez had swollen the ranks of Venezuela’s public employees to 2.5 million in a country where the 15-64 population numbered only 18 million. With 1 public employee to every 7 working adults, the entire mess was subsidized by oil exports and debt. When the price of oil fell, only debt was left.Those public employees became Chavez’s campaign staff with no choice but to vote for him or see their positions wiped out to keep the economy from crashing. And they won him one last election.

The dead tyrant leaves behind the lowest GDP growth rate and highest inflation rate in Latin America. He leaves behind an economy where more than half the population depends on government benefits or government jobs. He leaves behind a giant pile of debt for the people and 2 billion dollars in misappropriated oil money for his heirs.

But we don’t need to look to a leftist banana republic south of the border to see how profitable fighting for the poor can be.

7 of the 10 richest counties in America are now in the Washington D.C. area. Arlington County alone added $6,000 to its average income in one year alone. D.C. and its bedroom communities got rich at twice the rate of the rest of the country and in the last election; Obama won 8 of the 10 richest counties in the country.

Washington D.C. is richer than Silicon Valley. Median income in the D.C. area hit $84,523 despite the city itself having horrendous unemployment and poverty statistics. The top 5 percent in D.C. earns 60% more than the top 5 percent in other cities and 54 times what the bottom fifth earns in that same city.

This wealth of government money isn’t a rising tide that lifts all boats. Income inequality in Washington D.C. is one of the worst in the nation. For families with children, the income inequality level in D.C. is double the average for the rest of the country.

But when you concentrate the wealth of the land in a single imperial city, then you end up with a sharp gap between the poor and the fighters for the poor. Mid-level jobs are disappearing, but high-level jobs continue to grow. Small businesses are going out of business, but lawyers and consultants are being hired at a breathtaking rate.

Washington D.C. has the highest concentration of lawyers in the country. 1 out of every 12 city residents is a lawyer. 1 in 25 of the country’s lawyers lives in Washington D.C. In 2009, the Office of Personnel Management reported that there were 31,797 practicing lawyers in the Federal government earning an average salary of $127,500 a year. Or to put it another way, the taxpayers were spending double Hugo Chavez’s 2 billion dollar net worth each year just to pay the lawyers.

That was in 2009. The numbers have undoubtedly gotten much worse since.

That same year there were 383,000 federal civilian workers with six figure salaries. Multiply that and you get all the debt that Hugo Chavez dumped on Venezuela being dumped out in a single year on American taxpayers.

The number of Federal civilian employees is only slightly higher than in Chavez’s utopian Socialist paradise, but average Federal employee salary clocks in at a mean $75,000.

Federal civilian employee wages and benefits run around $200 billion. The cost of the Federal workforce in a single year is more than double Venezuela’s entire national debt. During Nixon’s first year in office, $200 billion would have covered the entire Federal budget. Now it’s just the paychecks. In the United States Department of Health and Human Services, which oversees welfare and food stamps, among other things, 1,461 of HHS’ 64,750 employees earn over $155,000.

While the Obama Administration fires marines, it hires more civilian employees. 101 new Federal employees have been hired every day of Obama’s first term in office. In 1962, there were more American military personnel than Federal civilian employees. The number of military personnel has dropped sharply, but the number of civilian employees is higher now than it was then. And their salaries have become much higher.

But the civilian employees are only part of the picture. The massive deficit spending has turned Washington D.C. into a treasure trove of government grants and stimulus plans on the favor train. The national debt grew by 6 trillion dollars in one term of Obama adding $50,521 in debt per household. That money was used to buy favors and support across the country.

While Obama ran on a platform of taking care of the poor, he was raiding the social safety net to buy support from a coalition of billionaires that paid him back with bundled contributions and SuperPACs. Green Energy tycoons got rich on loans and grants, while the middle class imploded. Billions in taxpayer money was traded for millions in contributions in one of the dirtiest deals to take place outside an actual banana republic.

Like Chavez, Obama presides over a poorer country whose poor are convinced that he is the only thing standing between them and absolute poverty. Deficit spending and high debt has destroyed any potential for GDP growth leaving America looking like an oversized version of Venezuela.

The new America is not a booming economy, but a political power structure built on unsustainable spending. Like Chavez, Obama has created an impossible trap that leaves half the country dependent on him and leaves his opponents with no alternative but to propose some form of austerity. It is an economic kamikaze maneuver that invariably ends with economic or political destruction.Obama, like Chavez, has made economic recovery structurally impossible, perpetuating poverty in order to profit politically from the national state of misery. Chavez died before the consequences of his economic policies caught up with Venezuela. Like Chavez, Obama won a contentious election, but he has no easy escape from the economic destruction coming up on the road ahead.

    Ex-Secret Service Agent: Obama ‘Absolutely Not Telling the Truth’ on White House Tours

    Former Secret Service agent Dan Bongino told Breitbart News that President Barack Obama was lying when he blamed the cancellation of White House tours on his former agency.

    “The president’s absolutely not telling the truth when he said the Secret Service made that decision to cut [the White House] tours,” Bongino said. “That’s the core of it: he is not telling the truth.”

    In an interview with ABC News’ George Stephanopoulos, Obama said the decision, made as a part of sequestration, was not one “that went up to the White House.”

    “But what the Secret Service explained to us was that they’re going to have to furlough some folks,” Obama said in the interview. What furloughs mean is–is that people lose a day of work and a day of pay. And, you know, the question for them is, you know, how deeply do they have to furlough their staff and is it worth it to make sure that we’ve got White House tours that means that you got a whole bunch of families who are depending on a paycheck who suddenly are seeing a 5% or 10%–reduction in their pay. Well, what I’m asking them is are there ways, for example, for us to accommodate school groups–you know, who may have traveled here with some bake sales. Can we make sure that– kids, potentially, can–can still come to tour?”

    Bongino, who served 12 years in the Secret Service including five years working directly at the White House before leaving to run as a Republican for U.S. Senate in Maryland, said Obama is lying because the Secret Service does not make such decisions.

    “The Secret Service does not make political decisions,” Bongino said. “The Secret Service makes security decisions. His statement that it was a Secret Service decision internal budget decision–and keep in mind, I’m not speaking for the Secret Service, I’m speaking from experience of being with them. All he’d have to do is cancel one or two of his political trips and his Martha’s Vineyard vacation, which two years ago I was on and helped coordinate, he would save that money times ten. There was just no way this was a sound decision. To insinuate this is the first administration where the White House social office and the Executive Office of the President had no role in cancelling public tours at the White House, that he was the first president who was left out of the decision, is absolute nonsense.”

    Bongino said he thinks the president is using “the Washington Monument strategy”–a ploy by a politician who tries to garner public opposition to spending cuts by eliminating popular public services first–in doing this to White House tours. “He wanted to inflict, there is no question in my mind, maximum pain upon the American people. But here’s the caveat: it had to be public pain. If you don’t see it, it doesn’t hurt.”

    But Bongino said all the public pressure Obama has taken for the decision to cancel the tours caused the ploy to “backfire.” Regardless, the ex Secret Service agent who served three years at the George W. Bush White House and two years at Obama’s White House said Obama still will not admit he was wrong and is now trying to blame the Secret Service for his own behavior.

    “Instead of coming clean and being honest with the American people that your office and likely you as well had a role in this, he’s again pulling the wool over your eyes just like he’s done on Benghazi, the immigration release [of thousands of illegal immigrants] where he said he didn’t know and Janet Napolitano said she didn’t know, this is nonsense,” Bongino said. “These are not security or budget decisions. These are strictly political decisions. Make no mistake about it.”

    Bongino said the Secret Service is not correcting Obama because the agency has “a great, elite group of guys and they’re always going to take it on the chin.”

    “I don’t speak for them but they’re obviously a patriotic group of men and women and they’re not lying when they say there will be overtime costs saved so it’s not like they’re being disingenuous,” Bongino said. “They’re trying to cover for this guy, I think, because they know it looks bad and they don’t want to get involved in the politics and I don’t blame them.”

    Palin Bolsters Insurgents at Conservative Retreat

    Sarah Palin’s appearances no longer inspire speculation about her presidential aspirations, but her reception at a large gathering of conservatives on Saturday underscored her enduring popularity with the right. In a speech here, she offered zingers for the Republican base but also a strenuous defense of her Tea Party friends who are challenging the Republican establishment.

    In a sweeping pep talk at the Conservative Political Action Conference, Ms. Palin, a former governor of Alaska and Republican vice-presidential nominee, attacked President Obama and the Beltway Republican groups that are promoting traditional candidates over insurgents in Republican primaries.

    “More background checks?” she asked, railing against new gun control proposals offered by Democrats in Congress. “Dandy idea, Mr. President. Should’ve started with yours.” Lines like that frequently brought the crowd to its feet, as did a dramatic sip from a Big Gulp cup, to mock Mayor Michael R. Bloomberg’s proposed ban on soda cups bigger than 16 ounces in New York.

    Despite her exit from electoral politics after the 2008 presidential election during which she was John McCain’s running mate, Ms. Palin has an enduring type of influence within the conservative movement. Many of its upstart office holders credit her with their success. They include Senator Ted Cruz of Texas, who introduced Ms. Palin hours before he delivered the keynote address.

    “She can pick winners,” said Mr. Cruz, who beat the state’s lieutenant governor in a primary last year. “I would not be in the U.S. Senate today if it were not for Gov. Sarah Palin.”

    Acknowledging that “we can’t just ignore that we lost a big election,” Ms. Palin said that “the last thing we need is Washington, D.C., vetting more candidates.”

    In an apparent reference to Karl Rove, who established the Conservative Victory Fund to oppose insurgent primary candidates, she added, “The architects can head on back to …” Jeers from the crowd drowned out her proposed destination.

    Ms. Palin’s name was one of 23 that appeared on the ballot for the convention’s annual straw poll, an early measure of the base’s sentiments toward potential nominees for president. Senator Rand Paul of Kentucky won a narrow plurality, 25 percent, of the 2,930 votes cast. (His father, Representative Ron Paul, frequently won the straw poll despite limited success in the real Republican primaries.)

    Senator Marco Rubio who has also worked to find consensus on issues like immigration, came in second, with 23 percent. Their combined showings illustrate the emergence of a younger generation on the right, both among elected officials and the base. A majority of those voting in the straw poll, 52 percent were between the ages of 18 and 25, according to organizers.

    Some much-discussed potential candidates, including Jeb Bush, the former Florida governor who gave a prominent speech on Friday night, were not on the ballot. And 14 percent of those voting wrote in a name that did not appear.

    Mr. Paul is likely to follow in his father’s footsteps and run for president, said Ron Nehring, a former chairman of the California Republican Party. “But,” he said in a Twitter message, “don’t put stock in these straw polls, which have 0 predictive value.”

    On Saturday, those gathered at the Gaylord National Resort and Convention Center on the Potomac River outside Washington heard from two other rising stars and sources of 2016 speculation. Gov. Scott Walker of Wisconsin, who beat back a union-driven recall effort last year, spoke about political lessons from his state that could be applied nationally. Yet his suggestions were more modest in scope than those offered by other potential 2016 candidates, focusing more on how to reframe union fights than on how to fundamentally change the perception of the party.

    A completely new face to many was that of Ben Carson, the celebrated neurosurgeon. Famous for separating conjoined twins, the once apolitical doctor quickly earned the affections of conservatives when he criticized Mr. Obama’s tax and health policies at the National Prayer Breakfast last month, as the president sat just feet away.

    Obama to Israelis: ‘Put Yourselves in Shoes’ of Palestinians

    On Thursday, President Barack Obama spoke in Jerusalem – a city he once promised would remain undivided – about all of the shortcomings of the state of Israel. Lecturing Israel about its democracy, economy, foreign policy, and basic humanity, Obama harangued the Jewish State while stumping for a “possible” two-state solution.

    Obama led off with the usual bevy of platitudes, plus a few cultural jokes. “This is a nation of museums and patents, timeless holy sites and ground-breaking innovation,” he gushed. “[A]ny drama between me and my friend Bibi over the years was just a plot to create material for Eretz Nehederet,” he continued, referencing a popular Israeli television show.

    He paid tribute to the need for Israeli security without offering any solutions. He stated, “I also think about a people who have a living memory of the Holocaust, faced with the prospect of a nuclear-armed Iranian government that has called for Israel’s destruction.” Obama obviously had no problem with his administration repeatedly leaking Israeli security information that could have allowed Israel to launch a strike to prevent that second Holocaust. And in Jerusalem, Obama continued to insist that negotiations would be the real solution, despite all evidence to the contrary.

    He suggested that Israel would not be going anywhere, despite its enemies opposition to its existence. But he actually stated that Israel could not continue to exist unless it made concessions to the Palestinians: “Given the demographics west of the Jordan River, the only way for Israel to endure and thrive as a Jewish and democratic state is through the realization of an independent and viable Palestine.”

    He offered no real solutions on how Israel would stave off its enemies in the aftermath of a devastating Muslim Brotherhood sea change throughout the Middle East. Actually, he went further – he said that in the aftermath of a popular revolution bringing Israel’s direct enemies to power, Israel should cave: “This is precisely the time to respond to the wave of revolution with a resolve for peace.”

    But all that was prelude. His real agenda was hijacking the Jewish story to apply to Palestinian Arabs who largely support the outright destruction of the state of Israel. “I believe that Israel is rooted not just in history and tradition, but also in a simple and profound idea: the idea that people deserve to be free in a land of their own,” Obama said. He then stated, “the Palestinian people’s right to self-determination and justice must also be recognized.

    “Put yourself in their shoes,” the President condescendingly urged, to a population assaulted with rockets and suicide bombs for decades. “Look at the world through their eyes. It is not fair that a Palestinian child cannot grow up in a state of her own, and lives with the presence of a foreign army that controls the movements of her parents every single day.” Obama did not mention the basic fact that the Palestinian leadership has repeatedly denied every multilateral and Israeli offer for a state; that they have stolen hundreds of millions of dollars from economic development; that they have channeled cash toward funding a low-level terror war with Israel; that Israel has handed over vast swaths of land to Palestinian Authority control. And Obama didn’t bother to explain how justice requires the creation of a terror state that would murder gays and condemn women to second-class status. No, Obama said, it was Israel’s lack of understanding that was the chief barrier to peace.

    Then Obama insulted Israel’s democracy: “Only you can determine what kind of democracy you will have. But remember that as you make these decisions, you will define not simply the future of your relationship with the Palestinians – you will define the future of Israel as well.”

    What, though, of Palestinian intransigence? What of the fact that after two full decades of Oslo, there is no two-state solution? Obama simply rewrote both history and current events. As it turns out, the Palestinians don’t want Israel’s destruction. They’re ready for peace. “While I know you have had differences with the Palestinian Authority, I believe you do have a true partner in President Abbas and Prime Minister Fayyad,” said Obama, all evidence to the contrary. Obama explained that “peace is possible,” even if “it doesn’t seem that way.” Sure, Jews may die. Sure, rockets may fall on S’derot. But hope and change! “Peace beings … in the hearts of people … in this sacred city of Jerusalem,” Obama blathered. “You must create the change that you want to see. I know this is possible …. Your hopes must light the way forward.”

    And finally, this whopper: “Sometimes, the greatest miracle is recognizing that the world can change.”

    No, Mr. President. The greatest miracle would be the world finally recognizing reality. But Obama has no interest in reality. He is interested only in himself, and in his role as world visionary.

    Jerusalem Post Editor: ‘We Can’t Figure Out What He’s Doing Here’

    Caroline Glick, Senior Contributing Editor of the Jerusalem Post said the Israeli people consider President Obama “a hostile president overall,” on “Mornings on the Mall” on WMAL-FM in Washington DC.

    Appearing with Brian Wilson and myself Wednesday morning, Glick said the Israeli people “can’t figure out what he’s doing here,” when asked about the mood in Jerusalem as the President’s plane touched down for the first time in his presidency.

    “Essentially his goal is to empower the un-electable, incredibly radical left in Israel to put pressure on the Israeli government for whatever concessions he wants it to make to the PLO,” said Glick in evaluating the reasons why Obama will be meeting with university students and members of the Palestinian Government during his visit.

    When asked about how the installment of Chuck Hagel as the Secretary of Defense was received by the Israeli people, Glick said, “It’s a hostile act.”

    Very interesting video just out today of Barack Obama taking a question from Obama-friendly reporter Chuck Todd of NBC/MSNBC. Todd attempts to get feedback on recent Israeli polls indicating Barack Obama has a nearly SINGLE DIGIT approval rating in that country – America’s only true Middle East ally.
